A man accused of licking a woman’s toes has been cleared of sexual assault after telling police the DNA found on her foot was because he was sneezing.
Shaun Smith stood accused of leaving saliva on the woman’s foot when he knelt down in front of her and kissed her bare feet.
A court heard how the 54-year-old was repeatedly told to stop by his victim.
He also tried to put his hand up her skirt, before pinning her down on a sofa and kissing her neck and chest, the court was told.
But Smith denied there had been any sexual touching during the encounter.
When confronted by police with forensic evidence, he said he was suffering from a heavy cold and the saliva on her foot was actually the result of a sneeze.
Maidstone Crown Court in Kent heard he also claimed his alleged victim had been rubbing herself against him and must have planted his DNA on her feet.
Smith, of Sheerness, in Kent, denied sexual assault over the incident in September 2015.
Today, a jury of eight men and four women found him not guilty after just 15 minutes of deliberation today.
